The effect of 2) on the jury trial ordered by the 10th Circuit Court of Appeals in 1) is yet to be seen, but the Chap. 11 Trustee's job is to preserve fund$ to pay the creditors.  Therefore it is possible he (Edward N. Cahn, Esquire, a former judge) will summarily dispense with the huge monetary sink-hole that has become of all the litigation.  IBM's and RedHat's counter claims against SCOXQ.PK still linger though...
