Support for the ext3 fs was incorporated into the main kernel source
tree with the 2.4.15 release.  However, there was a serious bug with the
2.4.15 release, so it should be avoided.
If you want to compile a kernel with ext3 fs, without having to patch it
yourself, I'd suggest grabbing the 2.4.16 release.  You can get it from
ftp://ftp.us.kernel.org.
